<content:encoded><![CDATA[<p>We love them, we hate them.  Is there any other profession in the world that is more polarizing than lawyers?  We have a pretty good firm on retainer, and one of their team just had his identity stolen.  I sympathize deeply with anyone who fights that battle.</p>
<p>To make it worse, they also stole the firm's role as our legal representative.  So when a debt showed up with a third party, we were "black listed" because our lawyer's name was on the documents.  But it was his stolen identity, not him personally.  Fortunately, it wasn't a large amount outstanding, and because of the reputation things were cleared up with uncommon cooperation with between the parties (except, of course for the one that stole the identity in the first place.)  But hey, he's a lawyer.  Let him sue!</p>

They are an excellent substitute for the pancakes you used to eat before the SCD. This is one of those recipes that makes you feel like you aren't missing a thing.</p>
<p>I add a mashed banana or two to the recipe and fry them in ghee. The ghee gives you the butter flavor, but doesn't brown as badly as butter.</p>
<p>You'll have to fry them at a relatively low temperature so they don't burn. I cover my frying pan to help them cook through. Until you get the time and temp figured out, you may want to make one at a time. I use two frying pans at the same time and it still takes awhile to cook all the batter.</p>
<p>I have found that there is a certain danger in making these pancakes though. I want to eat them all right away.</p>
<p><strong>Pros:</strong><br />
Way tasty - a real treat.</p>
<p><strong>Cons:</strong><br />
They take a while to cook if you are impatient and they can be habit forming.</p>

<p>A New York man who broke his tooth on an unpopped kernel of movie theater popcorn has lost his bid for compensation.  Insurance broker Steve Kaplan says he bit into a hard kernel, suffering terrible pain and a subsequent $1,250 dental bill.  In dismissing Kaplan's lawsuit this week, Judge Matthew Cooper said that anyone who has ever eaten or made popcorn "soon learns the bitter truth: that the final product is almost always marred by the presence of unpopped, partially popped, or burnt kernels."</p>
<p>Three cheers for the wise judge!</p>

<title><![CDATA[McCain camp sends letter to YouTube about DMCA takedowns of McCain videos for alleged copyright infringement]]></title>

<content:encoded><![CDATA[<p><strong>News:</strong>  Several people have alerted me to the copyright controversy brewing over at the McCain-Palin camp, and at YouTube.  McCain's attorney sent YouTube a letter--addressed to CEO Chad Hurley, GC Zahavah Levine, and copyright counsel Bill Patry--asking YouTube to make a determination that McCain's unauthorized uses of copyrighted content are clearly fair uses and therefore should not be removed after a DMCA complaint.  Apparently, several McCain videos--McCain's letter says "<strong>numerous</strong>"--have been removed by YouTube after YT received DMCA notices from copyright holders alleging that McCain had infringed their copyrights by posting videos with their content, which McCain's camp says consisted only of clips of 10 seconds or less of copyrighted news broadcasts.</p>
<p>The DMCA does have a "counter-notice" procedure that allows people to seek the re-posting of videos taken down under a DMCA notice, but the process takes between 10 to 14 days for that to happen, which the McCain camp says is not quick enough for the impending election.</p>

<p><strong>Analysis</strong>:  First things first.  Against today's backdrop of the financial crisis, this controversy over YouTube videos does seem, well, somewhat trivial.  Also, there is some irony in complaining now about "<strong>overreaching copyright claims</strong>" under the DMCA, a law that I believe McCain voted for in 1998.  I am <strong>generally sympathetic, though, to the McCain camp's</strong> call for liberal fair use in the context of a presidential election.  I've written an <a href="http://lawreview.law.uiuc.edu/publications/2000s/2008/2008_5/Lee.pdf" target="_blank">article arguing exactly that (click here). </a></p>
<p>One of the problems for YouTube, though, is that the fair use doctrine is notoriously vague, to be judged on a case-by-case basis.  What is "clearly" fair use may depend on the eye of the beholder.  Companies like YouTube follow the DMCA notice-and-takedown procedure in a more cautious manner, in order to avoid being sued.  But the DMCA itself is vague in places -- that's why YouTube faces 2 major copyright lawsuits asking YouTube to pay damages of over $1 billion. </p>
<p>It's just too bad we haven't had any discussion by either presidential candidate about reforming the DMCA at any point in the campaign season.  And with the financial crisis, copyright issues might never get discussed before the election. The frustrations McCain's lawyers have expressed to YouTube are not new--they are ones with "overreaching copyright claims" that regular people have faced since the DMCA regime was enacted.  Don't get me wrong:  I'm all for a DMCA safe harbor for Internet companies, but the one we have may need some tweaking or clarification.</p>
<p>I do wonder a little bit about what McCain videos have been removed, and what news networks have actually sought their removal. The McCain camp says "numerous" McCain videos have been removed from YouTube.  How many are we talking about?  I follow all the presidential videos pretty regularly, and I know only of 1 such McCain video involving <a href="http://theutubeblog.com/2008/09/10/cbs-sends-youtube-dmca-notice-over-john-mccains-unauthorized-use-of-katie-couric-segment-in-lipstick-on-a-pig-video/" target="_self">a clip of Katie Couric that had been taken out of context </a>and used in a negative ad against Barack Obama to suggest inaccurately that Couric was commenting about "sexism" in Obama's use of "lipstick on a pig."  Is that kind of use of Couric's broadcast, taken out of context and used in a negative attack ad, a fair use?  Hard to say, debatable at least.  It would be helpful if the McCain camp identified which videos have been removed and posted them all on the McCain website, where it has a <a href="http://www.johnmccain.com/tvads/" target="_blank">section for videos</a>.  Then we can know what copyright holder or news network sought the takedown, and see if all of it should be considered fair use or not.<br />

UPDATE</strong>:  YouTube wrote a letter to McCain denying his request, citing both practicality and the impossibility of determining fair use with reasonable certainty without a court ruling.  "Lawyers and judges constantly disagree about what does and does not constitute fair use. No number of lawyers could possibly determine with a reasonable level of certainty whether all the videos for which we receive disputed takedown notices qualify as fair use," wrote the YouTube general counsel. <p class="MsoNormal" style="margin:0;"><span style="font-size:small;"><span style="font-family:Times New Roman;"><span>            </span>I do not know the person running against Judge Winegarden, and will not make any comments about her qualifications or lack of qualifications to be a Gwinnett County Judge.<span>  </span>From looking at the Court docket, it appears that she is a criminal defense attorney that also does some divorces.<span>   </span>It is for the voters to decide if her experience qualifies her to decide the important legal issues in major cases including the major crimes in Gwinnett.<span>  </span></span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:small;"><span style="font-family:Times New Roman;"><span>            </span>I will say that with his 20+ years on the bench presiding over major cases, including major felony trials, Judge Winegarden definitely has the experience to be a Superior Court Judge.<span>  </span>Moreover, because he has loyally served this County, my county, for over 20 years, and because he will not participate in a negative campaign, he has demonstrated that he also has the character to be a “Gwinnett County” Superior Court Judge.<span>   </span></span></span></p>

<p class="MsoNormal" style="margin:0;"><span style="font-size:small;"><span style="font-family:Times New Roman;"><span>            </span>In a recent case decided by Judge Winegarden, Judge Winegarden decided in favor of the Defendants as a matter of law on a case involving false arrest.<span>  </span>The facts of the case were not in dispute and the decision was made purely on Judge Winegarden’s interpretation of Georgia law.<span>  </span>The Plaintiff appealed and the Georgia Court of appeals overturned part of Judge Winegarden’s decision.<span>   </span>However, the Defendants then appealed to the Georgia Supreme Court.<span>  </span>In true Winegarden fashion, the Court of appeals decision was overturned in favor of the decision originally entered by Judge Winegarden.<span>   </span>Therefore, Gwinnett Superior Court Judge Richard Winegarden understood the law and the legal issues better than the panel of Judges sitting on the Georgia Court of Appeals.<span>  </span></span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:small;"><span style="font-family:Times New Roman;"><span>            </span>In every trial someone has to win.<span>  </span>The parties that lose will always complain.<span>  </span>As a party to a case we always want to win.<span>  </span>As citizens we want and expect that our Judges will make the right decisions.<span>  </span>Although all Judges can make a mistake, or the Appeals court can decide to interpret a law differently than a trial Judge, without question, Judge Winegarden has the experience and the intelligence to get it right.<span>    </span></span></span></p>

<p>Workers who feel wronged by their employers often assume that they can take their grievances to court, but increasingly, they must pursue their claims through arbitration -- a route that can result in smaller damage awards.</p>
<p>The reach of arbitration in employment disputes has been evident in a high-profile case over alleged wrongdoing in Iraq. Jamie Leigh Jones, a 23-year-old Texan, claims that in 2005 she was raped there by fellow employees at <a class="companyRollover link11unvisited" href="http://arbitrationhorrorstories.wordpress.com/public/quotes/main.html?type=djn&#38;symbol=HAL"><span style="color:#093d72;">Kellogg Brown &#38; Root</span></a> Inc., a government contractor and former <a class="companyRollover link11unvisited" href="http://arbitrationhorrorstories.wordpress.com/public/quotes/main.html?type=djn&#38;symbol=hal"><span style="color:#093d72;">Halliburton</span></a> Inc. subsidiary.</p>

<div class="insetContent">The incident recently sparked outrage and media attention, in part because no criminal charges have been filed. Now it appears Ms. Jones may not be able to pursue her sexual-harassment lawsuit, which was filed in a Houston federal court this year. Kellogg Brown &#38; Root, which denies the claim, maintains Ms. Jones waived her right to trial when she signed an employment agreement in 2005 that requires workplace disputes to be arbitrated. Ms. Jones has asked a federal judge to disregard the agreement, arguing that Kellogg Brown &#38; Root didn't live up to its obligations to provide a safe, abuse-free environment.</div>

<p>Arbitration of employment disputes took off in the early 1990s after federal legislation made it easier for workers to sue -- and win big damages -- over claims such as sex, race and disability discrimination. Intent on reducing large payouts and litigation costs, companies responded by putting in place arbitration programs in which disputes are heard not by a judge or jury, but by an arbitrator.</p>
<p>Typically, disputes are handled by a single arbitrator, who, as a lawyer, may be less likely to be swayed by emotion than a jury would be. In arbitration, workers also face greater constraints on the amount of evidence they can gather to support claims. Proceedings usually are private, and final awards aren't easily overturned by courts.</p>
<p>Employment arbitration now covers a wide swath of industries, from restaurants and retailers to law firms and banks. An estimated 15% to 20% of businesses now require employees to arbitrate disputes, according to Alexander Colvin, a labor studies professor at Pennsylvania State University. By contrast, a 1995 government study indicated that less than 10% of companies had employee-arbitration programs.</p>
<p>Companies that now use arbitration for employment disputes include <a class="companyRollover link11unvisited" href="http://arbitrationhorrorstories.wordpress.com/public/quotes/main.html?type=djn&#38;symbol=c"><span style="color:#093d72;">Citigroup</span></a> Inc., <a class="companyRollover link11unvisited" href="http://arbitrationhorrorstories.wordpress.com/public/quotes/main.html?type=djn&#38;symbol=MS"><span style="color:#093d72;">Discover Financial Services</span></a> and <a class="companyRollover link11unvisited" href="http://arbitrationhorrorstories.wordpress.com/public/quotes/main.html?type=djn&#38;symbol=cc"><span style="color:#093d72;">Circuit City Stores</span></a> Inc. "Companies have turned to arbitration to resolve cases more quickly and to reduce damage awards," says Connie Bertram, a Washington-based employment defense lawyer at Winston &#38; Strawn LLP. Companies also frequently use arbitration to resolve customer disputes.</p>
<p>Though prevalent and widely favored by courts, employment arbitration remains controversial. Plaintiffs lawyers and consumer advocates complain that workers often win relatively meager awards and that the secretive process allows companies to sweep problems under the rug. A bill introduced this year in Congress would prohibit companies from mandating the arbitration of employee and consumer disputes, but the legislation, the Arbitration Fairness Act of 2007, is believed to face long odds.</p>
<p>Companies increasingly fear the kind of high-profile payout that Madison Square Garden, a unit of <a class="companyRollover link11unvisited" href="http://arbitrationhorrorstories.wordpress.com/public/quotes/main.html?type=djn&#38;symbol=cvc"><span style="color:#093d72;">Cablevision Systems</span></a> Corp., suffered this year when it paid $11.5 million to settle a sexual-harassment case involving New York Knicks coach Isaiah Thomas. Both Madison Square Garden and Mr. Thomas denied any wrongdoing.</p>
<p>Proponents of arbitration argue that while juries sometimes give huge awards, they also can award nothing; arbitrators, they say, are more inclined to provide at least some damages. People on both sides of the debate say that very large awards are less likely in arbitration. But data on outcomes conflict: Some studies show that employees fare worse in arbitration than in court, while others conclude that employees win more often in arbitration and recover comparable amounts. Studies show that employment arbitrations are resolved twice as quickly on average as lawsuits.</p>
<p>Companies often introduce arbitration programs by including them in employment applications for new hires, or by announcing they're establishing one for current employees. Companies can fire -- or refuse to hire -- workers who decline to sign arbitration agreements, according to lawyers. Courts have held that an employee need not even sign an arbitration agreement to be bound. (Some courts have held that a signature is required.)</p>
<p>"Courts are always looking for ways to reduce their caseload," says Michael Maslanka, a lawyer who defends companies in employment disputes. "There is a presumption that employment disputes are arbitrable."</p>
<p>Mary Kay Morrow, a former employee of Hallmark Cards Inc., is currently contesting an arbitration policy adopted by the company in 2002. Ms. Morrow sued for age discrimination after she was fired in 2003. She claimed she couldn't be bound by an arbitration agreement that she never signed. But a Missouri court ruled in 2004 that she consented to arbitration merely by continuing to show up at work after the company mailed her a copy of the arbitration policy. Ms. Morrow is appealing.</p>
<p>Hallmark denies that it committed age discrimination or that Ms. Morrow has grounds to avoid arbitration. "Arbitration is more timely, less expensive and more confidential" than court cases, says company spokeswoman Julie O'Dell. A lot of workplace disputes involve personal issues that "should be kept confidential," she says. "It protects the individual and the company."</p>
<p>Employees can ask courts to disregard an arbitration agreement at the inception of a dispute, or they can ask courts to vacate an arbitration award. "For all practical purposes, unless the arbitrator is on the take, the arbitration award is not going to get set aside," Mr. Maslanka says.</p>
<p>Employees have had more success striking down discrete elements of an arbitration agreement, such as requirements that workers shoulder much of the costs of arbitration or caps on the amount of damages workers can recover. Courts have declared such terms "unconscionable," but the typical remedy, lawyers say, is to strike the offending provision and then allow the arbitration to proceed.</p>
<p>"There is little incentive to write arbitration agreements correctly the first time," says Cliff Palefsky, a San Francisco plaintiffs attorney. He represents an employee of Neiman Marcus Group Inc. who has a disability claim and objects to the company's arbitration agreement, which was adopted this year.</p>
<p>"We believe there are multiple defects with the agreement, but there is no guarantee that if a court agrees, we will be able to bring the case in court," Mr. Palefsky says. "They may just be allowed to rewrite the agreement and fix it."</p>
<p>Neiman Marcus declined to discuss the case, but says that its arbitration process "is fair, it is quick ... and covers all disputes."</p>
<p>Ms. Jones, for her part, claims she signed Kellogg Brown &#38; Root's arbitration agreement without realizing that she was being asked to work in a "sexually lawless" environment, where harassment was allegedly common. Had she known, she claims, she never would have waived her right to trial. "If the judge tosses us out of court, we'll get thrown into the star chamber that is arbitration, and we'll never be heard from again," says her attorney, L. Todd Kelly.</p>
<p>Kellogg Brown &#38; Root said it is committed "to providing a safe working environment for all employees." Arbitration, it says, "is a method for resolving employee disputes quickly and efficiently, without the delays and expense often associated with litigation."</p>

<title><![CDATA[BLOG ACTION DAY 2008: Spotlight on POVERTY-in-LAW]]></title>

<description><![CDATA[I signed up to write about poverty for Blog Action Day 2008 a few weeks back and the possibilities s]]></description>
<content:encoded><![CDATA[<p>I signed up to write about <span style="color:#339933;"><strong>poverty</strong> </span>for <a title="Blog Action Day 2008" href="http://blogactionday.org/">Blog Action Day 2008</a> a few weeks back and the possibilities seemed endless and somewhat overwhelming. Then I considered the phrase "<strong><span style="color:#339933;">write about what you know</span></strong>." Well, my professional life has been absorbed with access to justice and its mission - <strong><span style="color:#339933;"><em>expand and enhance legal representation to South Carolinians with low income.</em></span></strong> Luckily it doesn't take a <a title="rocket scientist" href="http://www.jpl.nasa.gov/multimedia/podcast/rocket-scientist-20060818/">rocket scientist</a> to realize that this is <strong>THE <span style="color:#339933;">poverty </span>topic</strong> for me!</p>
<p>To get there, it's time for a little background on me. Please indulge me.</p>
<p>My parents modeled philanthropy for me. From an early age, I learned that giving to someone in greater need than you felt really good. In my early teens, I worked as a <a title="candy striper" href="http://en.wikipedia.org/wiki/Hospital_volunteer">candy striper </a>and visited nursing homes with my church youth group in addition to dropping off goods at my local <a title="Goodwill" href="http://www.goodwill.org/page/guest/about">Goodwill </a>store. Years passed and I kept the spirit alive continuing to do charitable works, but it didn't hold the same meaning for me.</p>
<p>That's when I sat on a jury. All of a sudden I realized that law held a lot of power over most of us - at some point in our lives. It dawned on me that I could go to law school and help people in the process. ( I had been a travel agent for over 11 years and had transferred me from <a title="Chicago" href="http://www.cityofchicago.org/city/webportal/home.do">Chicago </a>to <a title="Greenville, SC" href="http://www.greatergreenville.com/">Greenville, SC</a>.) Mind you, my friends called me out and said "<em>Law school? To help people? Lawyers don't help people</em>." I held my ground.</p>
<p>I studied for my <a title="LSAT" href="http://www.lsat.org/">LSAT </a>and sent away for my undergrad records, completed paperwork, and updated my shots. I considered how to pay for law school and reasoned I could sell my house and use what little equity I had to help buy books and pay tuition. I applied. And I got in. Whew!</p>
<p>Oh yeah, I quit my job.</p>
<p>And started at the <a title="USC School of Law" href="http://law.sc.edu/">USC School of Law</a>. As a <a title="1L" href="http://en.wikipedia.org/wiki/One_L">1L </a>at age 34. And I went to meet <a title="Pamela D. &#34;Pam&#34; Robinson" href="http://law.sc.edu/administration/robinson/">Pamela D. "Pam" Robinson </a>my very first day. She got me started with pro bono in law school right away. And she kept me busy, er, I stayed busy with pro bono throughout law school. I had the pro bono <em><strong><span style="text-decoration:underline;">bug</span></strong></em> so to speak. I was a vounteer advocate for <a title="SisterCare" href="http://www.sistercare.com/">SisterCare</a>, a guardian ad litem for <a title="Richland County CASA" href="http://www.rccasa.org/">Richland County CASA</a>, and worked on special projects for the <a title="SC Bar" href="http://www.scbar.org/">SC Bar </a>to name a few things.</p>
<p>After law school I started working at a private, non-profit organization, <a title="P&#38;A" href="http://www.protectionandadvocacy-sc.org/">Protection and Advocacy for People with Disabilities, Inc.</a> (P&#38;A). Although a requirement for becoming a client was to have a disability, many times my clients were also living below, at or barely above the <a title="federal poverty guidelines" href="http://aspe.hhs.gov/poverty/08Poverty.shtml">federal poverty guidelines</a>. Why? Because many of them were denied employment due to their disability aka disability discrimination. Others had unimaginable monthly or weekly medication bills and even if there were recipients of either <a title="Medicaid" href="http://www.dhhs.state.sc.us/dhhsnew/index.asp">Medicaid </a>or <a title="Medicare" href="http://www.medicare.gov/">Medicare</a>, they were still unable to purchase ALL their meds. And don't forget about housing disability discrimination, even in <a title="HUD" href="http://www.hud.gov/">HUD </a>housing. There were lawsuits based on transportation discrimination. Abuse and neglect. Firsthand I witnessed degrading and deplorable living conditions for people with mental illness and cognitive impairments whose living arrangements were supplemented by <a title="SSI" href="http://www.ssa.gov/pgm/links_ssi.htm">SSI</a> and <a title="OSS" href="http://www.workworld.org/wwwebhelp/ssi_state_supplement_south_carolina.htm">OSS</a>.</p>
<p>These individuals were and many of them are living in <span style="color:#339933;"><strong>poverty</strong>. </span><span style="color:#000000;">Which brings us back to the topic at hand. I came to the South Carolina Access to Justice Commission to assist those very people and others like them living in <strong><span style="color:#339933;">poverty</span></strong>. </span></p>
<ul>
<li>Battling discrimination assists people in <strong><span style="color:#339933;">poverty</span></strong>.</li>
<li>Working as a pro bono attorney assists people in <strong><span style="color:#339933;">poverty</span></strong>.</li>
<li>Providing self-represented litigants with appropriate materials assists people in <strong><span style="color:#339933;">poverty</span></strong>.</li>
<li>Supporting legal services assists people in <strong><span style="color:#339933;">poverty</span></strong>.</li>
<li>Providing legal assistance to the homeless assists people in <strong><span style="color:#339933;">poverty</span></strong>.</li>
<li>Supporting the Bar Foundation assists people in <strong><span style="color:#339933;">poverty</span></strong>.</li>
</ul>
<p>How? People in <strong><span style="color:#339933;">poverty </span></strong>are subject to daily stress. Where will I work? How can my child eat? How do I get to this job interview? How do I pay my car insurance? Which medication do I pay for - my heart medication or my anti-psychotic medication?</p>
<p>Bench, Bar and public can assist people in <strong><span style="color:#339933;">poverty </span></strong>by supporting ACCESS TO JUSTICE. When people in <strong><span style="color:#339933;">poverty </span></strong>show up at your door and have dreadful stories of discrimination, offer them hope. Refer them to their local Legal Services Intake line (<a title="in SC" href="http://www.sccej.org/intake.htm">in SC</a>) to request assistance. Refer them to the court's website for forms (<a title="in SC" href="http://www.sccourts.org/forms/index.cfm">in SC</a>). Send them to <a title="SC Appleseed Legal Justice Center" href="http://www.scjustice.org/">SC Appleseed Legal Justice Center </a>for material. Take a look at <a title="resources" href="https://scaccesstojustice.wordpress.com/resources/">resources</a>. AND DO NOT GIVE UP!</p>
<p>There are many of us who are battling <strong><span style="color:#339933;">poverty </span></strong>, in ways familiar to us. We're forming partnerships and alliances. South Carolina Access to Justice is battling <strong><span style="color:#339933;">poverty </span></strong>by way of the law. Join us, won't you?</p>

<p>Today's tale comes from landlords Wilber and Julie Williams - a couple who help put the ASS in Tallassee, Alabama one good ol' boy day at a time.</p>
<p>These two twits sling stupid <strong>so</strong> well they got the attention of the <a title="Tallasse landlords force couple with black friends to move" href="http://www.wsfa.com/Global/story.asp?S=9153239" target="_blank">U.S. Department of Housing and Urban Development (HUD)</a>, which charged the degenerate duo with violating a nifty little piece of legislation we like to call the Fair Housing Act after they forced a white couple to move from a rented home because they were seen ...<br />

<p>The whole mess began back in February <a title="tallassee landlords force couple to move" href="http://sojourningboston.blogspot.com/2008/10/hud-tallassee-couple-forced-to-move.html" target="_blank">when the cankerous couple rented a house to Melissa Jones and her family</a>. Things were going along just fine until one day in May when the Frankenpair did a drive-by at the exact moment that <em><span style="color:#800000;">*gasp*</span></em>  BLACK PEOPLE were <em>visiting</em> with Jones!!!<br />
<em><span style="color:#339966;">::: How shocking in these modern times and all - right?  Oh wait ... it's Tallassee ... I think they're still holding out for a Confederate win ... :::</span></em></p>
<p>According to Jones' statement to HUD authorities, <a title="Tallasse landlords force couple with black friends to move" href="http://www.wsfa.com/Global/story.asp?S=9153239" target="_blank">her bias bitch of a landlord later called her demanding, "Those people need to leave. I don't want them on my property."</a></p>

<p>The phone transcript is said to show Julie Williams saying, "If y'all want to have African-Americans to visit, we're going to ask you to move ... this has never happened with any renters that we've had ... It's not fine on our property."<br />

<p>The case goes on to state that Jones told her landlord she wasn't just <em>friends</em> with black people -- but that she had <em>family</em> members (bluud tahz, y'all) who were of mixed ethnic background. She says she was then told to "go ahead and move before the rent's due for July."<br />

<p>Melissa Jones told HUD authorities that the McCainiac called again in July to pressure her into moving, telling her, "You should live in the projects if you want to interact with those people. I will sell the house if I have to in order to get you out. I don't care if you made a complaint to HUD, you have to move."<br />

<p>The couple moved the first of September.<br />
If a U.S. Administrative Law judge finds the depraved defendants guilty he can award damages for actual loss, emotional distress, humiliation, and loss of civil rights.<br />
